RENTAL AGREEMENT

819 Devon Court, San Diego, CA 92109, hereinafter called LANDLORD and
___________________ of __________________________________ hereinafter called
TENANT, hereby agree that:
1.
LANDLORD rents and TENANT
hires 819 Devon Court, San Diego, California, hereinafter called
"Premises" to be used for temporary living space. LANDLORD certifies
that he is the owner and entitled to rend the premises. TENANT is an adult at
least 21 years of age empowered to enter this agreement and is doing so on
behalf of themselves and their immediate family or adult friends. Note that
TENANT shall not sublet any or all of premises nor assign this agreement.
2.
The rental begins on
Saturday, _________, 2006, at 2pm and ends on Saturday, ________, 2006, at
10am. LANDLORD agrees to supply the premises in a clean, ready to use state
with normal furniture and fixtures, dishes, linens and so on.
3.
Rent is $1,645 per week
during 7/1-8/19 and $1,295 per week during 6/3-6/30 and 8/19-9/16. 20% of the
rent is due/was paid at the time of the reservation, and the remainder plus a
$275 deposit is due four months before the beginning date in #2.
4.
Upon termination of tenancy,
LANDLORD may use this deposit to repair damages to premises caused by TENANT,
guests or invitees, normal wear and tear excepted, to pay any toll-call phone
charges incurred by the TENANT, and to clean premises. Cleaning is generally
$75. Within one to two months after the end date in #2 (depending on getting
the phone bill), LANDLORD shall inform TENANT of how the deposit was used and
refund any unused balance.
5.
TENANT will indemnify and
save harmless LANDLORD from all liabilities and claims for damages, including
TENANT's arising out of LANDLORD's ownership and TENANT's use of premises.
6.
This agreement may be
terminated by either party giving the other written notice. TENANT agrees to
these terms if TENANT cancels a reservation:
- Within two weeks of initial reservation: deposit minus $75 is refunded.
- Before four months before rental start: deposit is not refunded.
- After four months before rental start: only security deposit refunded unless
another renter is found; then 80% of rent and the security deposit are
refunded.
7.
TENANT shall not violate any
governmental law in the use of premises, commit waste or nuisance, nor annoy
or interfere with other tenants or neighbors.
8.
TENANT acknowledges that
there is limited parking for TENANT's auto on site that may or may not
accommodate TENANT's vehicle, and that TENANT's guests or invitees should
expect to park off-site on the adjacent streets or in the public (free)
parking lots.
